Terms & Conditions for “I heard a kiwi” app

Welcome to “I heard a kiwi” (the “App”). These Terms and Conditions (“Terms”) govern your use of the App, which is provided as a tool for manual registry and logging of kiwi bird encounters.

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Purpose of the App

“I heard a kiwi” is designed for enthusiasts to manually record instances of hearing kiwi in the wild. The App is intended for personal, non-commercial use and citizen science purposes.

2. User Accounts and Authentication

  • Account Creation: You may use the App anonymously or create an account using your Google or Apple credentials.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your authentication details and for all activities that occur under your account.
  • Account Deletion: You may delete your account at any time through the App’s settings. Upon deletion, your Personally Identifiable Information (PII) linked to your Google or Apple account will be permanently removed.

3. User-Generated Content and Data Ownership

  • Observation Data: When you log a kiwi encounter, you submit data including location coordinates, timestamps, and the number of calls heard (“Observation Data”).
  • License Grant: By submitting Observation Data, you grant the App and its developers a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, store, display, reproduce, and distribute this data for the purposes of maintaining the kiwi registry.
  • Anonymized Data Retention: You acknowledge and agree that if you delete your account, your previously submitted Observation Data will remain in the App’s registry in a strictly anonymized format, completely dissociated from your identity.

4. Acceptable Use

You agree not to use the App to:

  • Submit false, misleading, or fabricated Observation Data.
  • Interfere with or disrupt the App’s functionality or servers (including Cloud Firestore and Firebase Crashlytics).
  • Attempt to reverse-engineer, decompile, or extract the source code of the App.
  • Trespass on private property or restricted conservation areas while attempting to record kiwi calls.

5. Privacy and Location Data

Your privacy is important to us. The App requires access to your device’s location services to function correctly and append geographic coordinates to your logs. Our data collection, usage, and storage practices, including our use of Firebase services, are detailed in our Privacy Policy. By using the App, you consent to the practices described in the Privacy Policy.

6. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the App or the registry data. We do not guarantee that the App will be free from bugs, crashes, or interruptions.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the developers of “I heard a kiwi” shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or other intangible losses resulting from your access to or use of, or inability to access or use, the App.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of New Zealand.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the “Effective Date” at the top of these Terms and, where appropriate, providing an in-app notification. Your continued use of the App following any revisions constitutes your acceptance of the new Terms.
